Family mediation is a way to work through discord without having to go through the court system to see some type of resolution. All family mediation proceedings are private and confidential, and our attorneys act as a neutral third party who helps to create a compromise or solution for the situation in question.

How Does It Work? 


This process is completely voluntary; you or those joining you in the mediation process may withdraw from the proceedings at any point. Our job is to be an unbiased third party that helps the clients come to fair joint decisions. Once an agreement has been made, Gans & Gans Family Law Attorneys will devise a formal document outlining the terms and arrangements that have been agreed upon. That agreement will not be legally binding until all parties involved have signed. 

Mediation is sometimes confused with arbitration, which is where the lawyer comes up with an agreement for parties to adhere to. With family mediation, you and any other involved party will be making your own choices and agreeing to terms that you have established. 

What to Expect from Mediation Services

Mediation services save you the cost of a trial and allow you more control as you negotiate. However, if you are considering mediation, be aware that it is still an extremely competitive process and you might not find yourself completely satisfied with the outcome. That being said, many parties prefer mediation services to avoid the hassle and expense of a trial; mediation tends to resolve more quickly, allowing you to get through the process and finalize everything sooner. A mediator does not decide the outcome of a case; he or she is there to help you air your grievances, resolve disputes, and agree on a satisfactory outcome together.  This can make mediation an excellent option if you want a smooth transition to allow yourself to move on.

While mediation is less formal than a trial, you will still go through distinct stages of the process. The mediator and each party all get the chance to make an opening statement; then, there is some group discussion in which the mediator encourages each party to respond to specific grievances in order to get a clearer sense of the issues. After that, each party will get a chance to meet privately with the mediator to discuss the strengths and weaknesses of their cases and how they would likely fare at trial. This allows both parties to have an idea of where they stand as an agreement is reached.
